NEW Indiana Law Lenders Response to Short Sales     We SOLD and Closed on a Property Today January 2nd, 2009 that was

 Subject To Lenders Approval of a Short Sale.

The Purchase Agreement was received by us via Fax from the Buyers Agent and Jeff contacted the Sellers Lender's Loss Mitigation Department the next morning.

He listened to the usual "sch-peal" of how LONG an answer would take and the LIST of requirements that needed to be in place (pre-lim HUD, hardship letter, etc...) even BEFORE they would consider reviewing this offer.

I walked over to him while he was on the phone and handed him a highlighted portion of

A New Indiana Law passed to help Homeowners facing a Short Sale...

Indiana HOUSE BILL 1359  an excerpt which reads :

"Requires a creditor, a mortgage servicer, or an agent of a creditor to acknowledge a written offer made in connection with a proposed short sale of property that is subject to a mortgage transaction that is at least 60 days delinquent. Provides that the acknowledgment must be provided not later than 10 business days after the date of the offer. Requires the creditor, servicer, or agent to accept or reject the short sale offer not later than 30 business days after receipt of the offer."

I heard Jeff read this exerpt to the Representative on the phone and then ask to speak to a supervisor:)

ONE WEEK ( 7 Calendar Days ) later, the offer was accepted and 3 weeks (21 Calendar days) after that the Final HUD 1 Statement to Close was Approved!  28 DAYS TOTAL - now that's a Short SALE!!!

Even the Buyers Agent was surprised..LOL

It will be a great NEW Year in Indiana, if other Lenders follow this example and heed THE NEW LAW affecting Short Sales  :)                                                                                                                           New Years Wish Lenders Cooperate with REALTORS to get Short Sales Done FAST

There are monetary fines to the lending institution for failure to adhere, if the new TIME guidelines to keep Short sales SHORT is not upheld!

As PROFESSIONAL REALTORS....We'd rather work collaboratively WITH BANKS and LENDING Institutions to facilitate Successful Short Sales & help PREVENT the CLOGGING UP OF OUR PUBLIC Court Systems and Honorable JUDGES time.  Not to mention the waste of Indiana TAX PAYERS MONEY when a home forecloses ( who pays court system employees & sheriffs? we do ;)

There are ready, willing, and able buyers shopping NOW with Interest Rates LOW.......WAY BEFORE a house deteriorates and depreciates a neighborhood by standing empty for a year!

Home Featured on HGTV's Hidden Potential is SOLD with Out of The Box Thinking!

     In May, the gracious Cast & Crew of HGTV's Hidden Potential TV Show visited Northwest Indiana's Porter County to feature 3 Local Homes For Sale.The Episode did not air on television until late August, but gave us some Publicity in the Local News!

After the episode aired on TV, we listed one of the Properties that was featured in Episode # 608.

The 4th weekend this home was listed (day 36 on the Market to be exact) we had 2 separate interested parties come through the home with their REALTORS each scheduling a second showing a day later!

Now, 2nd showings for us in THIS MARKET mean one thing: get the REVERSE OFFERS typed up and ready to present to the Buyers Agent!

I can remember Jeff using the words " out of the box thinking"  in talking with the Buyers Agents ahead of time and explaining the concept - they were both open minded to the concept and agreed to present the offer to their clients as well.

We've blogged about reverse offers before and closed several deals because of them this year!

But, until this instance,  never before did we get together with our sellers and have the opportunity to write up 2 Reverse offers simultaneously on the same property!

Not all agents or clients "get" the concept, but in this case, the light bulbs went off and we had a signed agreement back in 24 hours!

This upcoming Thanksgiving will certainly be special for the new ownersof this unique home as well as for our retiring Sellers who were open minded enough to shift their paradigm and do something different than the usual and customary practices they had experienced in a lifetime of buying and selling properties!

Also, we had excellent collaboration & communication with the Buyer's Agent (who although unfamiliar with the concept of reverse offers, was forward thinking enough to present it to her buyers who accepted).

We look forward to helping more clients achieve their Real Estate Goals !

 Don't Skimp on the Recipe For Real Estate Success    Ever leave out an ingredient when cooking a tried & true recipe ?  Either by accident, you may forget a step, or worse yet, on purpose, you omit an important part of the recipe thinking :

Less Than 30 Days From For Sale Sign Going Up to Sellers Signing Documents at Closing - This Northwest Indiana Home Sold!

Another Northwest Indiana Home SOLD by the Safrin's Yesterday, we CLOSED on a HOME we Listed For Sale in Schererville, Indiana less than a month ago!

The Day we Listed This Property,  we gave the Sellers a " To Do List ' of suggestions or TIPS specific to their HOME to help create optimal showing conditions. We agreed to hold off on setting showing appointments for a week, to give them time to declutter and prepare the home for potential buyers to see. You only get a First Impression once :)

During that week, we were busy creating GOOGLE JUICE for this listing by syndication to various websites and Internet Marketing to the masses, as well as telephone & email matchmaking efforts to our sphere of influence and professional collegues :)

Calls started coming in a few days later to schedule showing appointments in advance and by the First Day of allowed showings there were 7 different buyers scheduled working with 7 different agents !

2 Offers to Purchase followed, one the same day, and one the next! A Multi -Offer Disclosure Form was implemented to give everyone a chance to bring their BEST OFFERS FORWARD....and the next night we presented 2 offers to our week old new clients to choose from!

Offer Price was not as much the deciding factor in this case as was ONLINE APPROVAL BY A REPUTABLE LENDER, which was wisely provided in by Documentation from the Buyer's Agent!

23 Days Later we CLOSED!
